Terms of Service

Welcome to ColorsOnMe. By using the ColorsOnMe mobile application ("the App"), you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Description of Service

ColorsOnMe provides AI-powered personal color analysis, virtual try-on features, wardrobe management, outfit planning, and AI style recommendations. The App uses artificial intelligence to generate results and suggestions based on photos and preferences you provide.

3. Account Registration

You must sign in using Apple Sign-In (iOS) or Google Sign-In (Android) to use the App. You are responsible for maintaining the security of your account. You must be at least 13 years old to create an account.

4. Free and Premium Plans

Free Plan: Includes 1 color analysis scan, wardrobe management (up to 20 items), style journal (up to 10 entries), outfit planning, and calendar features.

Premium Plan: Includes unlimited color analysis scans, all virtual try-on features (hair color, haircut, makeup, nails, dream outfits, headshot studio), AI stylist chat, body type analysis, unlimited wardrobe items, unlimited journal entries, and 15 AI image generations per week.

5. Subscriptions and Billing

• Premium is offered as an auto-renewing weekly, monthly, or yearly subscription.
• The exact price, billing period, and any promotional offer are shown in the app before you confirm your purchase.
• Payment is charged to your Apple App Store account or Google Play account at confirmation of purchase.
• Your subscription renews automatically for the same subscription period unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours before the end of the current billing period at the rate shown to you in the app.
• You can manage or cancel your subscription at any time through your device's subscription settings after purchase.
• If you reinstall the app or change devices, you can use the Restore Purchases option in the app to recover eligible subscription access.
• No refunds are provided for partial billing periods. Refund requests should be directed to Apple or Google, which handle billing and refund decisions under their own policies.
• Prices are displayed in your local currency when available and may vary by region, platform, or promotional eligibility.

6. AI-Generated Content

The App uses artificial intelligence to generate color analysis results, style recommendations, virtual try-on images, and chat responses. You acknowledge that:

• AI-generated results are suggestions and may not be perfectly accurate.
• Color analysis results are based on photo analysis and may vary with lighting, camera quality, and other factors.
• Virtual try-on images are simulations and may not perfectly represent real-world appearance.
• AI stylist advice is generated by AI and should not be considered professional fashion or beauty consultation.
• We continuously work to improve accuracy but do not guarantee specific results.

7. Usage Limits

Premium subscribers receive 15 AI image generations per week (rolling 7-day window). This includes virtual try-ons, dream outfit generation, headshot studio, and wardrobe background removal. Generation limits reset on a rolling basis and are shared across all features.

8. Your Content

You retain ownership of all photos, text, and other content you upload to the App ("Your Content"). By uploading content, you grant us a limited license to process, store, and display it to provide the App's features to you. We do not claim ownership of Your Content and do not use it for purposes other than providing the service.

9. Acceptable Use

You agree not to:

• Upload content that is illegal, harmful, or violates the rights of others
• Attempt to circumvent subscription restrictions or usage limits
• Use the App to generate misleading, deceptive, or harmful content
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use automated tools to access the App's services
• Share your account credentials with others

10. Account Deletion

You can delete your account at any time from the Settings screen in the App. Account deletion permanently removes all your data including photos, analysis results, wardrobe items, journal entries, and personal information. This action cannot be undone. Active subscriptions should be canceled separately through your device's subscription settings before deleting your account.

11. Intellectual Property

The App, including its design, features, AI models, and branding, is owned by ColorsOnMe. You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

12. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated results will be accurate. Your use of the App is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, ColorsOnMe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to dissatisfaction with AI-generated results, data loss, or service interruptions.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms. We will notify you of significant changes through the App.

15. Governing Law

These Terms are governed by the laws of Australia. Any disputes shall be resolved in the courts of Australia.
